Northern Roots Photography – Online Gallery Terms of Service
Effective Date: December 2025
These Terms of Service (“Terms”) govern your access to and use of your online photo gallery (“Gallery”) delivered by Northern Roots Photography (“NRP,” “we,” “us,” or “our”). By accessing, viewing, downloading, or purchasing images from your Gallery, you agree to these Terms.
1. Gallery Access
Your online gallery link is provided exclusively to you as the client.
You may share the gallery with family or friends at your discretion, but you are responsible for anyone who accesses the gallery with your link.
NRP is not responsible for unauthorized sharing or downloads by third parties once the link has been provided to you.
2. Gallery Availability
Galleries remain active for up to 1 year for weddings, and up to 30 days for portrait session from the delivery date unless otherwise stated in your contract.
After the expiration date, the gallery may be archived or deleted. A reactivation or re-upload fee may apply.
NRP strives to keep galleries available without interruption, but we do not guarantee continuous or error-free access due to hosting provider or internet-related issues.
3. Image Downloading
Your gallery may include high-resolution downloads, web-size downloads, or both depending on your contracted package.
Downloading images for personal use is permitted within the scope of your purchased digital rights (see below).
You are responsible for backing up your downloaded images. NRP is not responsible for lost files after the gallery expires.
4. Printing Rights & Usage
Unless otherwise noted in your contract:
Personal Use License Includes:
Printing for personal use (albums, gifts, décor, etc).
Sharing on social media with proper credit/tagging to Northern Roots Photography (if posting online).
Prohibited Uses:
Altering or editing images beyond cropping/light retouching (no filters, heavy adjustments, or AI manipulation).
Selling, licensing, or using images for commercial purposes without written permission.
Submitting images to contests, publications, or third-party vendors without approval.
5. Copyright + Ownership
All images remain the intellectual property of Northern Roots Photography.
Purchase of digital files grants a license, not ownership.
Copyright is not transferred to the client unless explicitly stated in writing.
6. Print Products
Prints, albums, and products ordered directly through your gallery are fulfilled by professional labs selected by NRP.
Any color or quality variations that occur with prints ordered outside the gallery are not the responsibility of NRP.
7. Edits + Retouching
All delivered images have been edited for color, exposure, and style consistent with NRP’s portfolio.
Additional retouching or specific edits may be requested for an additional fee.
Re-editing of original files by the client is not permitted.
8. Privacy
We do not sell or distribute your personal information.
Images may be used for NRP marketing, portfolio, and social media unless you have opted out in writing prior to your session or in your signed contract.
9. Refunds + Payments
Digital downloads, prints, and products purchased through your gallery are non-refundable.
All payments are processed securely through the gallery platform or third-party vendor.
10. Limitation of Liability
NRP is not responsible for technical issues, download failures, or data loss due to user error or device malfunction.
In no event shall NRP be liable for damages exceeding the amount paid for your photography session or gallery products.
11. Modifications to Terms
NRP may update these Terms occasionally to reflect changes in services or legal requirements.
Continued access to your gallery signifies acceptance of updated terms.
